For property owners

Billboard land use agreement.

A simple one-page partnership agreement. Here's what it says in plain language, and you can download the full copy to read or print.

What the agreement covers

  • 1. Permission to use land

You allow Landmark to install, operate, maintain and access one billboard on your property, in a spot you and Landmark agree on together.

  • 2. Revenue sharing

You receive the percentage written on the agreement of the advertising revenue Landmark actually receives for that billboard (not counting HST, refunds or credits). Payment and a revenue summary are sent once a year, within 60 days after the calendar year ends.

  • 3. Permits and costs

Landmark gets and pays for every municipal, provincial and other permit or approval. Nothing is installed until the approvals are in place. Landmark pays for installation, maintenance and removal.

  • 4. Cancellation

You can cancel at any time with 60 days' written notice, and so can Landmark. Landmark removes the billboard within 60 days after the agreement ends (weather and safe access permitting) and repairs any physical damage it caused, apart from ordinary wear.

  • 5. Ownership and responsibility

The billboard and ads stay Landmark's property. Landmark is responsible for its own work, contractors and activities on your land and carries commercial general liability insurance while the billboard operates. You keep ownership and normal use of your land, apart from reasonable access to the billboard.

  • 6. General

Ontario law applies. Any change must be agreed in writing by both sides, neither side can commit the other to obligations with third parties, and the agreement starts once both of you have signed.

This summary is for convenience only; the signed agreement is what applies. Your revenue-share percentage is filled in on your copy before signing. We encourage you to review it with your own lawyer.
